1. About these terms
These Terms of Use (“Terms”) are an agreement between you and KidzCloud Edutech Private Limited (“KidzCloud”, “we”, “us”) for use of the KidzCloud mobile app, the website at kidzcloud.in and related services (the “Services”). By creating an account or using the Services you agree to these Terms, our Privacy Policy, Community Guidelines and Child Safety Policy.
These Terms are an electronic record under the Information Technology Act, 2000 and are published in line with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
2. Who can use KidzCloud
- Students aged 5–18 may use KidzCloud only with the consent and supervision of a parent or lawful guardian, who accepts these Terms on the child’s behalf and is responsible for the child’s use.
- Parents and guardians must be 18 or older and legally responsible for the child they link to.
- Tutors must be 18 or older, complete our verification process and agree to any additional tutor terms shown in the app.
- Schools and institutions use KidzCloud under a separate written agreement where one is in place, which prevails over these Terms for matters it covers.
3. Your account
- One person – one account. Each account is personal. Do not share, sell or transfer it, or create accounts for someone else without authority.
- Give accurate information, including your real name, date of birth and role, and keep it up to date.
- Keep your login and one-time passwords confidential. You are responsible for activity on your account.
- Tell us immediately at support@kidzcloud.in if you think your account has been misused.
4. Acceptable use
You must not use the Services to host, display, upload, share or transmit anything that:
- belongs to someone else and you have no right to;
- is obscene, pornographic, paedophilic, invasive of another’s privacy, harassing, defamatory, or insulting or harassing on the basis of gender, religion, caste, race or ethnicity;
- is harmful to children;
- infringes any patent, trademark, copyright or other proprietary right;
- deceives or misleads, or knowingly communicates misinformation;
- impersonates another person;
- threatens the unity, integrity, defence, security or sovereignty of India, public order, or friendly relations with other states;
- contains viruses or other code designed to interrupt, destroy or limit any computer resource;
- promotes gambling, or advertises products or services to children; or
- violates any law in force.
You must also not contact children outside the platform, request personal information from them, scrape or copy the Services, interfere with security, or use automated tools without our permission. Our Community Guidelines explain this in plain language.
5. Content you post
You keep ownership of content you create. You give KidzCloud a non-exclusive, royalty-free licence to host, store, display and share it within the Services for as long as it remains on the platform, solely to operate and improve the Services. Children’s content is never used in marketing without separate consent from a parent or guardian.
We may review, moderate, restrict or remove content and suspend accounts that break these Terms. Where we act on content we will, where appropriate, tell the user why and how to appeal.
6. Tutors and courses
- Tutors are independent educators, not employees of KidzCloud. They are responsible for the accuracy and quality of their courses and must follow our Child Safety Policy at all times.
- Tutors must complete identity, qualification and payout verification before teaching or receiving payments, and must keep their details current.
- Course earnings are credited to the tutor’s KidzCloud wallet after applicable fees and taxes and can be withdrawn to a verified bank account, subject to the payout terms shown in the app.
- All teaching and communication with learners must take place on the platform.
7. Payments and subscriptions
Some courses and subscriptions are paid. Prices are shown in Indian Rupees and include applicable taxes unless stated otherwise. Payments are processed securely by our payment gateway; KidzCloud does not store your card or bank details.
Subscriptions run for the period shown at purchase. Refunds and cancellations are governed by our Refund & Cancellation Policy. Coupons are subject to the conditions shown with them and have no cash value.
Purchases on behalf of a child should be made by a parent or guardian.
8. Our intellectual property
The KidzCloud name, logo, app, website, design and our own content belong to KidzCloud Edutech Private Limited or its licensors. You may use them only to use the Services as intended. Course content belongs to the tutor or KidzCloud, as applicable, and is licensed to you for personal, non-commercial learning only — you may not copy, record, resell or redistribute it.
9. Suspension and termination
You can stop using KidzCloud and delete your account at any time — see Account Deletion.
We may suspend or terminate an account, with or without notice, if it breaks these Terms or the law, puts children at risk, or if we are required to by law. Serious safety violations lead to a permanent ban and may be reported to the authorities.
10. Disclaimers and liability
We work hard to keep KidzCloud available, accurate and safe, but the Services are provided “as is” and “as available”. We do not guarantee particular learning outcomes, results in competitions or uninterrupted access. As an intermediary, we are not responsible for content posted by users or tutors, but we act on it as described in these Terms and as required by law.
To the extent permitted by law, KidzCloud is not liable for indirect, incidental or consequential losses, and our total liability for any claim relating to the Services is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited under Indian law, including under the Consumer Protection Act, 2019.
11. Governing law and disputes
These Terms are governed by the laws of India. Please contact us first so we can try to resolve any issue. Subject to your rights as a consumer, the courts at Bengaluru, Karnataka have exclusive jurisdiction.
